I am in same situation and had a meeting with my attorney to get more information, according to his experience with all his cases to date, he said there is 70 - 30 ratio, 70% have recieved rfe and 30% got approved without rfe. And after july fiasco he said it's better to wait for rfe and respond rather then ammending 485 application, now that's another question that my attorney will easily make it to top 10 list of all time worst attorneys. So I am looking for second opinion too.
So I would say wait till you get an RFE and respond ASAP.

but does your I-140 need to be approved before you can use your EAD?
NO.U can start using it.But if 140 is denied you cannot renew it.
More importantly (as in my case), can I use my AP to travel if both my I-140 and I-485 are still pending?

tax returns. I do not think they expect you to list all the addresses that you stayed during the year.
You will need to provide the address to the tax return where your state taxes were deducted for the most part of the year IMHO. But for your GC app, I am unsure.
Have you consulted your lawyer? Send a PM to pappu maybe. He may get some answers from the IV lawyers.

If they never overstayed then USCIS has no case against them...get a lawyer to get them out..and then hire another lawyer to sue the USCIS. This is pure harrasment.

I don't understand why you don't want to depend on I-485 as the only source? If it is a straight forward case, there should be no issues. Your husband can be on EAD and there is no need for him to be on a "365 day exile", as you put it. Unless of course, you're worried that the labor sub I-140 could be denied?
I dont want to depend on pending I485 as the only source. I want each of us to have status independent of it.
I do understand that he can apply H1 only in Apr 08 and start working from Oct 08.
I am hoping a short visit will not reset his 365 day exile. One more query I have is can he leave US for around 10 days immediately after applying for I485. Should he apply for AP along with I485 or should he wait once he comes back after his short trip on a valid L2? Will it be OK ?

Thanks for your response, one of the RFE about my letter of experience from company A that it is not date, I mean that I have the starting dates and ending dates of my work but the letter itself does not have issue date, the RFR says that since the letter is not dated it cannot be considered, also that letter is my proof of 2 years experience prior to join company B. In your opinion how should I rectify that , should I go back to company A and ask them to issue me another letter with issue date on it and also should I ask any of my coworker from company A to issue me affidavit that I was working there. Will these options work.
Please advise.

Our finger prints does not change. They have our FP on their system. Providing new finger prints does not add any value to our case or US security.
Additional FPs just result in wastage of resources for us and USCIS (eventually tax payers). They can utilize same resouces for processing applications in FIFO.

Hi Guys,
I just wanted to get some input from the veterans here who have started a business in partnership while they have been waiting for the coveted green card.
What kind of legal paperwork does it take to start a business? I would think as long as you don't work for the business it should be ok? If you can own part of a corporation (stocks), you can be a partner in a business?

Here is the situation, they already got Australia visa stamped and would like to make a honest visit to US before leaving for Australia, nothing hidden. So how to Convince VO.
