My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.
H4 visa stamping Expires on Feb 20111.
She is planning to go India by Jan 2011 for 2 weeks. She is planning to come before Visa expires.
Is it possible to enter US with old H4 visa stamping?
Do we really need to stamp visa with F1?
F1 visa stamp is needed if she plans to continue her studies on F1 and would like to avail OPT.

I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

You can study on H4
You cannot accept a scholarship
You cannot take an in-campus job
You cannot do an internship, apply for CPT or OPT's
If the above are all true.. there is no need to inform USCIS

Hi psychman,
One way would be to iterate over all of the MultiScaleSubImages during load and store their ViewportOrigins and ViewportWidths. If I have time, I will try to see if I can create an example of it :)

I thought this will be a useful information to everyone.
My Case,
04/18/2008 -Applied EAD online
06/19/2008 -Status changes to "Approved" but no Notice sent.
07/20/2008 -Waited for 30 Days and called USCIS to open a Service Request.
07/24/2008 - Received EAD at home.
08/26/2008 - Received the letter from USCIS saying we have sent you the card but never received back or delivered to you hence concluding it is considered lost and if you need it, Please file for EAD again.
I called USCIS, Customer server rep said take an Infopass appointment to make sure it is valid.
Took the appointment, went USCIS on 09/10/2008.
Officer takes a look and tells me "Obviuosly you have EAD in your possession and unless you made it up on a color Laser printer, It is my fault that I have provided wrong information to USCIS and not waited for 30 days as I should have and I am there to pick up a fight with USCIS,bla bla bbla"
I remained very calm knowing he does not like his job but have to do it.
He is rude and clueless at the most why I am there. My first experience with USCIS, I dont think I want to go to their office again.
Finally conclusion he tell me "Once EAD is issued it remains VALID until you notify USCIS that it is lost or stolen or tempered with, USCIS DOES NOT take any proactive actions on EADs that are issued. Hence NO action is neccessary at this time"
Moral of Story is DO NOT go to USCIS if you receive such type of letter from USCIS after opening a service request for EAD.
I wasted a good amount of time and money just to take this BS.

My experiance.... My 6th year on H1 expired beg Dec 2007. I applied for H4 Mid November 07 and haven't received a response yet. My attorney said as long as you file H4 before your H1 expire you're in status.

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

I presently have a Nikon D100 which wife is beginning to use more and more....so I am thinking of purchasing another digital Nikon..........was thinking of getting the D70. However since I only need a body I was thinking of perhaps getting another D100 or maybe trading up from there. Any opinions offered would be appreciated.

company B is doing H1b only. Can the dependent candidate stay on company A's sponsored H4 approval ?

No need to file H4 till her current H4 expires. As long as you are maintaining continuous H1 status (without gaps), H4 would remain active till its current validity even if primary H1 applicant changes jobs. You can file her H4 extension of stay petition 90 days in advance from the current H4 expiration date.

My Son is in India and will be traveling back to US on 1st September 2009 and His passport validity expires on 28th February 2010. Is it necessary for us to renew his passport while he is in India it self for him to enter into US?
Also our H1B validity expires by 14th January 2010.
