My passport will be expiring in next 6 months. I do have an appt pending with US embassy Bombay. I have some queries, if someone can please guide me:
1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?
Pls suggest.

This is getting ridiculous...losing my patience
I think a controlled slow movement is good at the beginning of the year. Last year they had made, for example, EB2 India as April 2004 but they had to make it U after 1st quarter.
So, a controlled slow movement will leave to more un-used numbers in the 3rd quarter when they will then be forced to make big jumps in dates to use up annual visa numbers

What is a probable timeline for Eb3 to Eb2 porting ? If we are already using EB3 EAD and not renewed old H1b, is it still possible to apply for Eb2 labor ?

My dear friend, because when you have filed for I-485, so did 3,49,999 others. Your category will not get more than 3500 visas a year ((1,40,000 *7/100)/3). No matter what your priority date is, USCIS will not even get to your application for atleast a year and after that, the PD may not move forward for several years. At this rate you will not get a GC for several years !!!!!

The problem is in your brain (opps) I meant perception. You may be able to change jobs on EAD, but you cannot get promoted to a job with a different job description. Lobby to change the laws. Participate in lawmaker awareness programs. Expresss support to people who are trying to get laws changed in your favour. Go to Washington, DC this Tuesday, Spt. 18th and express your support to IV. Meet your lawmaker and ask what he/she can do for you.

My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.

My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.
Appreciate your help!

Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

Hello,
My labor certification was filed in December '07 and is in the process of audit (Fragomen law firm issue). Meanwhile, there is news that my company is being sold off. Will I be able to continue my GC process if the company gets sold off but I am able to retain the same job and title.
Is anyone else facing a similar situation? What are my options here?

I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Also, dont specify Medical emergencies. They sometimes ask you to provide letters from the doctors regarding this. You can just say that they need some more time to visit places.
Ideally, I wouldnt recommend, having them overstay. This might have issues in the future, if they plan to visit again.
If they have a 5 or 10 year multiple entry visas, they can go back home and come again in another 6 months or so.

I have read somewhere in the past that I can file I485 for this future job as the dates have now become current. Can anyone confirm this and any idea what is the general recommendation for the duration that I have to stay with this employer once I start the job.

I am not sure I understand why would you want to do this? You are on EAD, correct? This already gives you the right to work for any employer; getting an H-1B would be a step back in this regard. Am I missing something?
